I apologize for not knowing how to do this but I just reached 250 posts and would like to finally get an avatar. I read how you are supposed to go about uploading one under edit avatar but I'm not able to uncheck "do not use avatar" option and there is no upload tab. Thank you.

Check your post count again, you're 1 post short, probably from a thread you posted in getting deleted.

Once you reach the 250 count again, give it a little bit of time and you'll see the options in your User Cp section enabled to add an av.
