No, it's not an excuse. It's your responsibility to abide by the rules of the road. Bikers have a tendency to let themselves get carried away for the thrill of the ride. Whether or not that was the case here, it's his responsibility to abide the rules of the road, and his incompetence to conform to the law is his fault. After all, if he had killed a pedestrian in a section of the road where he was at fault, just as running a red light puts him at fault, would anyone care if he hadn't seen the person? Of course not! We knock the charge down to involuntary manslaughter, but one is still at fault for one's noncompliance.
