hello all,

is there an attorney amongst you War Room peoples?

this is one of the most wacky, unbelievable things i've heard of in quite some time;

Amazon was recently granted a patent for the process of shooting pictures against a white backdrop...
The actual patent includes extraordinarily specific language. For example, there has to be “at least one image capture device equipped with an eighty-five millimeter lens, the at least one image capture device further configured with an ISO setting of about three hundred twenty and an f-stop value of about 5.6.”
http://www.salon.com/2014/05/09/amazons_ridiculous_photography_patent_makes_mark_cuban_happy/

how can this be and how on earth can Amazon expect to enforce it?

just as an fyi;

1) an 85 mm lens is a classic "go to" lens for portrait photography when using DSLRs (digital single lens reflex camera).

2) an f-stop value of 5.6 is also a sort of default aperture setting for most portrait shooters, in studio, particularly amongst "blue collar" photographers, when using a standard DSLR.

to draw an analogy, it's a little like having a patent on crisp french fries. i'm all for patent and copyright protections (although most here on Sherdog probably aren't, since i assume everyone here downloads copyrighted material with impunity) - but isn't this crazy?

I don't even see the point in patenting a process you use? Just to be a dick head? To have justification of suing copy cats in the future? Well fuck them I'll use a cream background.

hi 2014Classic,

i would assume this patent was secured so Amazon could litigate against the use of this "technique".

Lol, the standard process of taking a photo? It makes no sense. What are they trying to protect is what I'm not getting. What/how does other people doing this hurt them?

If there's a way of making money because we haven't thought of it first, then good on them.

This patent should never have even been granted.

I'm still waiting to hear if my patent has been approved.

I proposed using a pair of metal blades pivoted so that the sharpened edges slide against each other when the handles (bows) opposite to the pivot are closed. It would have revolutionary applications for the separation of a physical object, or a portion of a physical object, into two or more portions, through the application of an acutely directed force.

Now if Apple tries to sue Amazon with their rounded edges patent, Amazon can counter sue with their white background patent. Nothing that extraordinary about these ridiculous patents sadly. You shouldn't be allowed to patent intangible things like business plans or photography methods.

F jeff Bezo just like his d-bag one click ordering patent this crap has to stop if not in the US maybe at the level of the world court. They now have the power to stop businesses from doing business in Europe about time to start flexing that muscle. They already for a short time stop microsoft and apple from shipping products to Europe. The US patent system has been bought by big companies. Its gone completely out of control. Apple has the patent on guess what curved glass? Yep curved glass on handheld devices and wearable technology.

Here is one of their patent descriptions.

I believe in US law someone can protest it if they have proof they were using it.

But at the same time the law allows someone to copyright a fucking a colour so who knows.

it is bullshit. Mark Cuban would rip this shit apart. there was a guy on Shark Tank who had a patent for running a wire through a jacket/vest. Just a wire. He sued about 8clothing companies who had no idea this was even a patentable idea for using "his" idea.

Could they be going after eBay users?

hello there Anuug,

possibly...but i don't think so. a great many E-bay folks are using camera phones nowadays.

camera phones, of course, have settings...but they are automated and the user really has no idea what they are. it's all done internally.

Amazon getting this patent is really weird. i have no understanding how they got this done.

hiya Supereem,

there isn't a professional studio photographer alive who hasn't used this technique, lol.

it would be like trying to patent a right jab.

Patent office has been a joke for a long time. The phrase "digital" appears to be +20 points.

A system designed to protect objects, has been extended to techniques and processes.

Scratching your right ass cheek with your left hand is not that groundbreaking.

Next step, patent the process of filing a patent.

Why the fuck not.

So why are they even granting patents for processes that you don't develop yourself?

Doesn't that defeat the entire purpose of a patent as a mechanism to protect returns off of R&D investment?

I'm going to patient jerking off. at $0.01 per time I'm going to be the new worlds richest man!

Bro don't you know that Suing people is the new R&D. Research ridiculous things to patent, develop lawsuits.
