The accused: Abdallah F., 48 years old, living in Berlin, Germany.
The deed: 'Especially grave case of rape'.
The victim: Mara A., 31 years old.
Abdallah F., the prosecution said, had invited Mara A. to his apartment in the district of Gesundbrunnen on 4 August 2015. There, she was attacked at around 17.30. Also several knives have been involved allegedly, with which Abdallah F. allegedly threatened the woman. Among them an approximately 30 cm long butcher knife. German law prescribes for cases of rape in which a weapon is used a prison sentence of at least five years.
After the complaint by Mara A., Abdallah F. was arrested and was for 17 days in custody. Judge Michael Rothbart said on Monday that he had "read [the files] several times". And that it was reasonably assumed that "the allegations were true" - otherwise he would not have opened the main proceedings.
Abdallah F. made use of his right to remain silent, what many observers had interpreted as sort of an admission of guilt - especially in a rape case, where you usually only have two - contradictory - statements. Mara A. heavily incriminated him in court. Her statements were "credible," the prosecutor said. Nevertheless, at the end only an acquittal was an option.
The reason is a video that Abdallah F.'s defender presented following to statements by Mara A. It can now be discussed how distasteful it is to record a sex video without the knowledge of the partner. In retrospect, Abdallah F. will be very happy to have done it. For this recording shows clearly and unequivocally that it was consensual sex. Prosecutor and court concluded also that this video could not have been recorded on another day. Mara A. had repeatedly stressed in court that she had been in Abdallah F.s apartment only once - on the day of her rape.
Now the woman is facing criminal proceedings for giving false testimony.
