Aldon Smith Trial News
An arrest warrant was reportedly issued Friday in Miami for former 49ers linebacker Nick Moody, who is scheduled to be a witness in Aldon Smith’s trial on charges of DUI, and hit and run.
Moody was asked to appear in a Miami courtroom Friday to assure a judge that he would travel to California to take the stand as a witness against his former teammate, the
Miami Herald reported.
Moody, 26, who spent 2013 and ’14 with the 49ers, is a Miami Beach resident. According to the report, Moody “has vanished, ignoring e-mails, text messages and calls from prosecutors on both coasts.”
“I’m stunned that Mr. Moody defied the court’s direct order to appear today,” Miami-Dade prosecutor Christine Zahralban told the judge, the
Herald reported.
In September, the Santa Clara County District Attorney’s office filed three misdemeanor charges against Smith stemming from an Aug. 6 incident that led to his release from the 49ers.
Smith signed with the Raiders a month later and appeared in nine games before the NFL suspended him for one year for violating the league’s policy on substances of abuse.
The charges against Smith are: DUI with a prior conviction and refusal to submit to a chemical test; hit and run with property damage; and vandalism under $400.
The 49ers released Moody before the start of last season. He signed with the Seattle Seahawks and saw action in three games. Moody is currently a free agent.
Moody and Smith were together the day Smith was arrested in Santa Clara, the
Herald reported, citing court documents. Smith’s trial is scheduled to start May 2. Miami-Dade prosecutors acted on behalf of Santa Clara prosecutors to order Moody to report to California to act as a witness, the
Herald reported.
According to the
Herald, if Moody is arrested in Florida, prosecutors are expected to request he is held in jail until he can be transported to California. He could also be held in contempt of court and sentenced to jail time.
