That "rebuttal" was awful and didn't really rebut anything.
People crying over their lost coal jobs are just another version of modern Luddites.
Coal is dead, move on.

You don't understand simple economics.

It's gotta be a good gig being an attorney for a rich, thin skinned baby who is paid to send letters to people who damage their client's fragile ego and then file frivolous lawsuits to assuage their suffering.

It must be a dream job can you imagine.

Defamation lawsuit over his piece about big coal:

"The complaint characterized the show’s segment as “false, injurious, and defamatory,” and an “attempt to advance their biases against the coal industry and their disdain for the coal-related policies of the Trump Administration.” The complaint notes that Time Warner “is widely reported as a top ten donor of Hillary Clinton.” Clinton, the complaint says, had an agenda of putting coal miners and companies out of business.

The complaint says that after the show informed Murray and the various companies of their plans for the show, Murray and the others sent information to counter the show’s claims, but the show “ignored them and ‘doubled-down- on their character assassination of Mr. Murray” and the others.

According to the lawsuit, the sources that “Last Week Tonight” relied on for their coal segment were “outdated,” and Murray told this to the show before the segment aired, saying, “You recklessly rely exclusively on previously discredited media reports.”

Original segment:

Crowder's rebuttal ("make the war room fair and balanced again"):

I have no guess as to how this will play out, but it could prove to be a bellwether regarding other suits brought against these shows that tend to hide behind the "entertainment" description.

Lol someones jimmies got rustled hard

Well the guy suing apparently will bring suit against anyone who speaks negatively about him or his company. Regardless of if what is said is factual or not. So I doubt the law suit will have much impact at all. Just tells me coal billionaire has too much time and money on his hands.

Easier for the owners to keep mines open and miners at work without draconian sanctions.

Draconian? Holding them up to safety and environmental standards is hardly draconian.

It's probably the correct point to make. I'm think the show did earnestly expect a suit thinking it would be good publicity and vindication/legitimization when they win.

Interested to see how it plays out!

Both sides have enough money to be dicks about the situation in a legal sense...

So the lawsuit was removed to federal court, where the ACLU filed an amicus (3rd party) brief, arguing that the case should be dismissed and that Bob Murray and his attorneys should be sanctioned for filing a frivolous suit (which a rarely exercised power of the courts).

It's fucking hilarious. Here are some choice bits:
The Complaint also interestingly claims that “nothing has ever stressed [Bob Murray] more than [John Oliver’s] vicious and untruthful attack.” As one media outlet asked, “s he really saying that a late night British comedian on a premium channel has caused him more stress than the time that one of his mines collapsed and killed a group of his employees? If so . . . that’s . . . weird.” https://www.techdirt.com/articles/2...oliver-is-even-sillier-than-we-expected.shtml

This case is beyond meritless. It is offensive to the very ideals of free speech embodied in the First Amendment. The fact that Plaintiffs filed this case is ridiculous enough; but, to pour gasoline on the fire, plaintiffs’ counsel has also filed a motion asking the court to make John Oliver not say mean things about him anymore. See Pl.’s Mot. [Docket 1-1]. It is frankly shocking that Plaintiffs were able to find attorneys willing to file a lawsuit that is so obviously unconstitutional. It is apt that one of Plaintiffs’ objections to the show is about a human-sized squirrell named Mr. Nutterbutter, because this case is nuts. Which also begs the question: is Mr. Nutterbutter one of the 50 Doe Defendants included in this action?

It should be noted that the very mean comparison arose from both a striking physical resemblance between the two
characters and a statement by Plaintiff’s General Counsel with an uncanny similarity to statements made by a more
youthful Dr. Evil. (The brief then cites to an article and the following youtube excerpt of Dr. Evil asking for a million dollars)

regarding a matter of public concern. As a flamethrower himself, Bob Murray should not be shocked when his own fire occasionally inspires others to fire back. This is the very purpose of the marketplace of ideas. See generally Snyder v. Phelps, 562 U.S. 443 (2011). The place to disagree on important matters of public concern is the court of public opinion, not United States District Court. See Hustler Magazine v. Falwell, 485 U.S. 46, 51-52 (1988). As one court has noted, “[o]ne planning to engage in politics, American style, should remember the words credited to Harry S. Truman ‘If you can’t stand the heat, get out of the kitchen.’” Desert Sun Pub. Co. v. Superior Court, 158 Cal. Rptr. 519, 521 (Ct. App. 1979). See also, e.g., Fletcher v. San Jose Mercury News, 264 Cal. Rptr. 699, 708 (Ct. App. 1989)

Plaintiffs argue that Defendants will use their “unique powers” to “access . . . millions of West Virginians, to bias the potential jurors who will determine their fate.” Pl’s Mem. at 3. (These special powers must include magic, as West Virginia has under 2 million residents.5)

You're right. I totally laughed. Especially at "III".

It's always funny to watch Liberals hide behind "entertainment" and "comedy" when they are caught full of shit, yet Jon Stewart was the #1 source for Liberals for a long time.
