Trademark is just a logo, Copyright protects original works of authorship so is more than just a logo, for example its the whole notion/story of Karate Kid.

Probably cause no one representing the property has approached him over it. There’s a company here in London Ontario that uses the Mickey Mouse and Spongebob theme songs in their radio ads. It’s been going on for years only because the right person hasn’t heard.

No clue, maybe he just changed enough and considering its just one reference to a film before it became a series.
I couldn’t say for sure but I wouldn’t risk branding something I owned with the same name and similar logo to something that already exists, even if it’s fictional. If you ended up having to rebrand everything, that would be a huge pain in the ass.
