Donald J. Trump Finalizes List of Potential Supreme Court Justice Picks

NEW YORK, NY - Today Donald J. Trump released a second list of individuals he would consider as potential replacements for Justice Scalia at the United States Supreme Court. This group builds upon the highly praised list of choices he named in May 2016. These individuals were selected, first and foremost, based on constitutional principles, with input from respected conservative leaders.

Mr. Trump stated, “We have a very clear choice in this election. The freedoms we cherish and the constitutional values and principles our country was founded on are in jeopardy. The responsibility is greater than ever to protect and uphold these freedoms and I will appoint justices, who like Justice Scalia, will protect our liberty with the highest regard for the Constitution. This list is definitive and I will choose only from it in picking future Justices of the United States Supreme Court. I would like to thank the Federalist Society, The Heritage Foundation and the many other individuals who helped in composing this list of twenty-one highly respected people who are the kind of scholars that we need to preserve the very core of our country, and make it greater than ever before.”
Keith Blackwell is a justice of the Supreme Court of Georgia. He was appointed to the position in 2012. He had previously served on the Court of Appeals of Georgia. Before serving on the bench, Justice Blackwell was a Deputy Special Attorney General of the State of Georgia, an Assistant District Attorney in Cobb County, and a commercial litigator in private practice. Justice Blackwell is a graduate of the University of Georgia School of Law.
Charles Canady is a justice of the Supreme Court of Florida. He has served in that role since 2008, and he served as the court's chief justice from 2010 to 2012. Prior to his appointment, Justice Canady served as a judge of the Florida Second District Court of Appeal and as a member of the United States House of Representatives for four terms. Justice Canady is a graduate of Yale Law School.
Neil Gorsuch is a judge of the United States Court of Appeals for the Tenth Circuit. He was appointed to the position in 2006. Judge Gorsuch previously served in the Justice Department as a Deputy Assistant Attorney General. Judge Gorsuch was a Marshall Scholar and received his law degree from Harvard. He clerked for Justices Byron White and Anthony Kennedy.
Mike Lee is the Junior U.S. Senator from Utah and currently serves on the Senate Judiciary Committee. He has previously served as an Assistant U.S. Attorney in Utah and as a Supreme Court Clerk for Justice Alito.
Edward Mansfield is a justice of the Iowa Supreme Court. He was appointed to the court in 2011 and retained by voters in 2012. Justice Mansfield previously served as a judge of the Iowa Court of Appeals. He also teaches law at Drake University as an adjunct professor. Justice Mansfield is a graduate of Yale Law School.
Federico Moreno is a judge of the United States District Court for the Southern District of Florida and a member of the Judicial Conference of the United States. He previously served as a state and county court judge in Florida. Judge Moreno is a graduate of the University of Miami School of Law.
Margaret A. Ryan has been a judge of the U.S. Court of Appeals for the Armed Forces since 2006. Judge Ryan served in the Marine Corps through deployments in the Philippines and the Gulf War. She then attended Notre Dame Law School through a military scholarship and served as a JAG officer for four years. Judge Ryan clerked for Judge J. Michael Luttig of the Fourth Circuit and Justice Clarence Thomas.
Amul Thapar is a judge of the U.S. District Court for the Eastern District of Kentucky, serving since his appointment in 2007, when he became the first South Asian Article III judge. He has taught law students at the University of Cincinnati and Georgetown. Judge Thapar has served as an Assistant U.S. Attorney in Washington, D.C. and the Southern District of Ohio. Immediately prior to his judicial appointment, Judge Thapar was the U.S. Attorney for the Eastern District of Kentucky. Judge Thapar received his law degree from the University of California, Berkeley.
Timothy Tymkovich is the chief judge of the United States Court of Appeals for the Tenth Circuit. Judge Tymkovich was appointed to the bench in 2003. He previously served as Colorado Solicitor General. Judge Tymkovich is a graduate of the University of Colorado College of Law.
Robert Young is the chief justice of the Supreme Court of Michigan. He was appointed to the court in 1999, and became part of a majority of justices who embraced originalism and led what one scholar described as a "textualism revolution." Justice Young previously served as a judge on the Michigan Court of Appeals. Chief Justice Young is a graduate of Harvard Law School.

Judge Neil Gorsuch will be the 113th Supreme Court justice. Here's what you can expect to happen before he takes his seat:
  • Swearing in: Gorsuch will be sworn in as associate justice in a private ceremony at the Supreme Court on Monday.
  • Who will do it: Chief Justice Roberts will lead that ceremony at 9 a.m. ET.
  • At the White House: Later that morning, Justice Kennedy will administer the oath at a public ceremony at White House.
  • Why Kennedy: It was Gorsuch's request. He and Kennedy have a special relationship: It's the first time a law clerk and his justice will sit on the bench together.
  • Who else will attend: The justices and spouses plan to be at the white house ceremony itself.

Senate's in recess right now. Obama should recess appoint Judge Stephen Reinhardt and then nominate a reasonable candidate. That'd force the issue.
 
I read an article written by David Axelrod where Scalia suggested to Axelrod that he wanted Kagan to replace him if he retired while Obama was President. Of course, that can't happen now but I wonder if there was another liberal leaning judge Scalia suggested would make a good Supreme Court Justice? If there's one Scalia praised, the Republicans in Congress would be hard-pressed to hold up the appointment of a new Justice for at least 11 months without the potential for political consequences come election time.

He didn't say that. He suggest Kagan if Obama were to appoint someone to the court to join them. Not to replace him

He was giving Obama advice through Axelrod about his appointments, not some replacement wish.
 
I've been reading that they want Lynch. What a joke. The one who went full thoughtcrime right after the San Bernardino massacre. Fuck that.

Asian-American judges among Obama's options as he seeks to replace Scalia

President Barack Obama has a number of likely options as he looks for a nominee to the U.S. Supreme Court to replace Justice Antonin Scalia, who died on Saturday. Here are some of the possibilities, including two prominent Asian-American judges:

Sri Srinivasan:

Among those the administration could turn to is Sri Srinivasan, 48, who has served on the U.S. Court of Appeals for the District of Columbia Circuit since May 2013. He would be the first Indian-American on the court and has impeccable bipartisan credentials.

The Senate confirmed him on a 97-0 vote three years ago. He was a law clerk to Supreme Court Justice Sandra Day O’Connor, now retired, a 1981 appointee of Republican President Ronald Reagan. At Srinivasan's confirmation hearing, Texas Republican Senator Ted Cruz, now a presidential candidate, described himself as a long-standing friend dating back to their time together as law clerks in the U.S. appeals court based in Richmond, Virginia.

Cruz said Srinivasan had done a "very fine job" in answering the committee's questions.

During his nomination to the appeals court, prominent Republicans such as former U.S. Solicitor General Ted Olson supported Srinivasan. At his 2013 investiture, leading lights of the legal establishment from both parties praised him. Federal appeals court judge J. Harvie Wilkinson, a Reagan appointee for whom Srinivasan was also a law clerk, called him “lightning smart.”

So far on the appeals court, his rulings have not sparked controversy.

Jacqueline Nguyen:

Other names the administration could consider include Jacqueline Nguyen, 50, a Vietnamese-American who has been a judge on the San Francisco-based 9th U.S. Circuit Court of Appeals since May 2012.

The first Asian-American woman to sit on a federal appeals court, she was confirmed by the Senate in 2012 by a 91-3 vote. When she was a child, Nguyen fled South Vietnam with her family toward the close of the Vietnam War in 1975, and then lived in a refugee camp in California. Nguyen was a federal prosecutor and district court judge in Los Angeles before she was elevated to the appeals court.

I actually heard a lot of discussions on Srinivasan in the thread dedicated to Antonin Scalia, before it was drown-out by the drive-by spammers who came to talk about "The Republicans" and "The Democrats".

One of the things with Sri is there's absolutely no good reason a GOP senator could refuse to vote for him except pure obstructionism. They just voted the man in unanimously. He's qualified. Hell, he clerked for a Conservative justice in Sandra O'Connor. If Obama wants to get someone in. If he wants to score points in the next election, he picks a Hispanic and lets the GOP eat shit for it blocking it.
 
The fact that lynch is being considered is pretty alarming and would be very telling if they tried to push her through.
 
Obama going to nominate Jacqueline Nguyen or Srinivasan, because one is East Asian and the other East Indian. My hunch is Nguyen.

Have not seen Lynch mentioned on Huffpo or any other MSM.
 
Why would that be alarming?

Pretty obvious that after the San Bernardino attack that she has very strong political influences that affect her decision making. That isn't someone I want on the Supreme Court.

I think sri would be a very good choice and someone that would force the hands of the Senate to avoid embarrassment.
 
I'm unclear on this part of checks and balances, but if the Senate obstructs this process, could they be sued and potentially force the Supreme Court to make them pick a new justice? Not that I think it would be likely, just really funny.
