A 67 year old retired doorman, Charles Foehner, from Queens was taking his trash out when a man tried to rob him and lunged at him. He was holding a pen that the retiree believed was a knife. All of this is backed up by surveillance video. The retiree shot and killed the man and while they decided the shooting was justified, it being NYC he was charged with illegal possession of a firearm.
A search of his residence found more firearms. He was threatened with 25 years-basically, a life sentence. He took a plea and was sentenced to 4 years in prison.
Not a felon. No criminal record. The man he shot had been arrested 12 previous times and was a violent offender.
Foehner is set to report to prison in January. Remember, he pled guilty to avoid life behind bars. He cooperated. The district attorney objected to the report date and asked he be remanded to prison immediately. The judge rejected the request to allow Foehner to spend Christmas with his family before reporting to prison for the next four years.
Upsetting. No second amendment rights in NYC despite Supreme Court cases (Heller) that ruled the draconian laws are unconstitutional. But…it gets worse. Below are cases where actual criminals have done worse and were either sentenced to less time, a similar amount of time, or just a little bit more time. All for illegal gun possession plus additional crimes. All cases are in New York City-same as Foehner. All cases sentenced in 2025 but crimes may have been committed in other years.

The first and third one are really bad.-actually, they’re all pretty bad.
Rashad porter, 21, was arrested for illegally possessing a firearm as well as a large amount of oxycodone and charged with possession with intent to deliver. Much more serious crimes yet he was sentenced to six years….wait, not years but MONTHS. Six months in jail, not prison, plus five years of supervised release. Oh, he didn’t take a plea initially and didn’t cooperate until trial and then took the plea. This is a little different that four years.
Michael Gonzalez-sentenced to 7 years. Prior violent felon with previous convictions for felon in possession of a firearm-he was actually on parole for such a charge when he threatened his ex over the phone- he showed up at her house and threatened her with a gun while she was holding her child. He was arrested and charged with gun possession, threats towards her and the child. A search of his residence turned up more firearms. He took a plea and yes, he got 3 more years that Foehner, but he had prior violent felonies and threatened a woman and child with his guns.

Prior multiple time felon. Serves six months and then he reoffends and then, he only gets five years.
He pled guilty to a felony state charge (crime not listed in article) and was sentenced to probation-not jail or prison. He had a protection order served on him by an ex and he showed up at her house and threatened her with the firearm. He was arrested and multiple guns and fentanyl found in his residence, including AR-15 with a fucking drum magazine. He did six months and was fucking sentenced to more probation. 8 months later, probation officers show up at his residence and due to him being on probation, they can search his residence as per an agreement. They find more firearms in his residence. He then pleas guilty to two counts of possession of a firearm by a felon and gets five years. I am guessing this guy snitched on someone the first time around because he did six months and was released.
Steven Gomez
Prior felon. Sentenced to PROBATION.
Gomez was a convicted felon-it does not say what the original felony was for-I looked, but the name is too common to narrow it down and I am betting he has more than just one felony. Anyway, he is arrested for possessing a Glock 17 by a felon after he is stopped for some reason in a shopping mall. But, it gets better-the Glock had its serial number burnt off with acid. A previously convicted felon with a firearm that has the serial number burnt off and he is sentenced to probation!!
Jesse Taber
Prior felon-sentenced to two years.
Not much on this one other than it says he was a convicted felon with three prior felony conviction and found in possession of a shotgun and was sentenced to two years in prison and three years of supervised release.
Now, back to the original case-Foehner. The DC vs Heller decision ruled that Americans legally allowed to possess firearms can at the very least, keep them within their home for self defense. So how is NYC still charging people with illegal firearm possession? And how in the fuck does this man get four years in prison for illegal firearm possession while all the others-who have long criminal records and are all felons-save the first guy, get less time. Several of the felons had violent felonies in their past and committed violent crimes that led police to their door on these occasions. The one guy, Gomez, got just six months for being a felon with multiple firearms and fentanyl and then he was caught again with a firearm while on probation and he got just five years in prison.
