A U.S. appeals court ruled on Friday that most of Donald Trump's tariffs are illegal, undercutting the Republican president's use of the levies as a key international economic policy tool.

The court allowed the tariffs to remain in place through October 14 to give the Trump administration a chance to file an appeal with the U.S. Supreme Court.

The court's decision does not impact tariffs issued under other legal authority, such as Trump's tariffs on steel and aluminum imports.

The appeals court ruled on two cases, one brought by five small U.S. businesses and the other by 12 Democratic-led U.S. states, which argued that IEEPA does not authorize tariffs.

Nothing burger. Still in effect. They stayed it until October 14th and it will be overturned well before then. Though some countries might stupidly gamble that it will stand and stonewall.

Obviously you can’t take the full power of tariffs away from the branch that negotiates trade unless it’s the courts position that the US must always negotiate from a place of weakness. Unable to do what other countries can do to us.

A lot of countries that are currently in trade talks, like Canada, might gamble that this ruling stands and not negotiate in good faith.

And obviously China and India don’t have activist judges telling them they have to deal from a place of weakness. You don’t think they plan to exploit the fact that democrats work against this country?

So we’ll see how countries act between now and October 14th..or whatever time this is struck down.

The reality is he is using emergency authority to impose the majority of these tariffs when there is no emergency. The only reason it's been allowed to happen at all is because the congressional republicans are just pussies.

Half the time Trump loses in court it's from judges he personally appointed.

Trade agreements need to be approved by congress. The fact that executive is in charge of the negotiation has no baring on that.
 
We can't tariff them, but other countries can tariff us? That doesn't sound fair. Why are they putting tariffs on our products in the first place?

You don’t understand how it works. The tariffs aren’t going anywhere. Even beyond October 14th. The case will go to the Supreme Court. While they won’t make a ruling within the next month, but they’ll definitely keep the tariffs in place as they review the case themselves(as the appeals court did) and decide to overrule or affirm the appeals court. Which can actually take years. The tariffs aren’t going anywhere.

I can imagine this scenario playing out, sure.

The topic still covers interesting ground, such as Trump using emergency measures in a non-emergency situation which obviously creates problems for himself, and calls into question the effectiveness of doing so if countries are potentially going to rebel/react.

There's plenty to dig into.

Calling it a "nothing burger" because it casts Trump in a bad light is lazy. Trump should have used the proper channels in the first place, and his methods should be unimpeachable. He's your leader. Demand better.

Having all the same options that are available to your counterpart is imperative to negotiation, don’t you think?

Especially when you have a party who is negligent like the democrats and have openly rooted against their country in negotiations. And are actively trying to weaken the negotiators.

Obviously telling another country that agreements need Democrat support is the same as going into an ass kicking contest without legs
