Defendants are left with big legal bills and little leverage since they can't file an effective counter-suit against a plaintiff with no operations.

I'm sure someone with more than second-hand law experience could tell you more, but a big part of corporate patent law is tied up in things like standing to bring a suit or assert damages. Also, I'm guessing the jury decision isn't that important, since it will presumably get appealed up to the higher courts even if it's pretty clear cut, given the amount of money at stake.
