And as a result, on January 13th, the NAC announced that Diaz's suspension was being dropped from 5 years down to 18 months, and from a $165,000 fine to $100,000. And as part of the negotiations, Nick Diaz would have to admit that when, during his original hearing, he pleaded "the Fifth" over and over in response to commissioner Pat Lundvall's questioning of him, he did so "wrongfully."

Here's Diaz's statement, in the settlement (via MMAFighting):

"After conferring with new counsel," Diaz wrote, "I determined that I wrongfully invoked Fifth Amendment in response to relevant questions posed by members of the Commission and that I should have, and would have, testified to the Commission that I did not use marijuana 'in-competition,' as that term is defined by the World Anti-Doping Agency ('WADA') in its Anti-Doping Code.""

Diaz's attorney, Lucas Middlebrook, explained the settlement, and why Diaz had to admit his wrongful use of the Fifth Amendment, in a statement to MMAFighting:

"It became apparent that the NAC wanted the Fifth Amendment issue as part of any negotiated settlement and therefore the choice was between lengthy litigation or having Nick resume his career this summer," Middlebrook said. "While I, along with my team, still fully stand by Nick's invocation of his Constitutional rights and maintain it was the right legal decision, our main focus was resuming Nick's career. I truly hope moving forward that due process of the law is a reality and not just a legal catchphrase."

So, while this may not be the absolute best thing for future MMA fighters looking to challenge the NAC's rulings down the line, for Nick Diaz fans, it means he's done what he had to to get back in the cage sooner.

I think you can only "Plead the 5th" if you are involved in a criminal trial, I don't think it applies to a disciplinary hearing by a sports commission.
 
nsac is such a joke, they made this over the top punishment, where they should fully have expected backlash, and the last thing they should have done was to negotiate after going there - they were trying to take a tough stance to show people what was up (set a new precedent etc.) - now they have no credibility, what a bunch of jokers - any time they make a ruling now, people are going to go apesht - any fool in their situation would know to stick to their guns no matter how dumb they are, now people smell blood every time they make a ruling

but for them, the only thing, at all, that matters is making money - so they kept the 100k and thats prob a good enough for them

maybe they actually fcked something up and dont want to admit it or got pressure from elsewhere, who knows what really happens - they should be replaced now though unless they want no one to take them seriously
 
It irritated those assholes that Nick wouldn't kiss their pale asses and answer their questions (on advice of his counsel, mind you) so they proceeded to do everything in their power to rake him over the coals. They felt disrespected, plain and simple. And they overstepped the absolute fuck out of their authority because of it. Every one of those ridiculous clown socks should be fired in the most publicly humiliating way possible, fined $750,000 each for mental damages they've caused Nick and mma fans in general, and have their law licenses revoked, and do 1 year in federal pound me in the ass prison. especially lundvall.

So basically the lawyer just said Nick committed perjury by issuing a statement that he wrongfully invoked the 5th amendment.​
