What if Trump married an illegal immigrant?

    No political commentary here. Interesting to us only as a study in immigration law. There are some missing facts that the Trumps do not provide. If we had to guess, however, Ms. Trump probably held a B1/B2 "tourist" visa in 1995 and most likely violated it by "working" as a model. Yes, posing for nude pictures in this context would probably be considered employment under the INA (And oh, how I would love to litigate this issue before the AAO). However, her probable immigration violations occurred in 1995-1996, before IIRAIRA became law. So the immigration consequences of unlawful employment were not as severe as they are now in the Post-IIRAIRA era. A much more interesting question is how Ms. Trump obtained her green card. Was it via employment based petition or marriage? From these facts, it looks like there was a 8-9 year gap between when Ms. Trump obtained her H1B Fashion model visa and her marriage to Mr. Trump. To my knowledge, H1Bs, even for fashion models, are only issued for a maximum of 6 years (unless you fall under a special AC-21 category which I doubt happened here. So unless Ms. Trump had an employment based green card, or changed her status to O1 or another non-immigrant visa, I dont know how to account for the two-three years that she could have been out of status from 1996 until her marriage in 2005. Did she marry Mr. Trump as a visa overstay? Again, no politics here. Just an example of how complicated our immigration laws are, even for those who try to comply with the law.
