Lawyers for the family of an unarmed black man killed by police in a busy Southern California parking lot said Monday an autopsy found he was shot 10 times and died from choking on his own blood as police delayed getting him medical help.

Police say he was wanted for car theft and had struck two police cruisers with his car before officers opened fire.

The autopsy concluded that 26-year-old Diante Yarber died of asphyxiation and that had he been given medical treatment, he would have had a chance at surviving his wounds, attorney S. Lee Merritt said at a news conference.

Barstow police officers fatally shot Yarber on April 5 in a Walmart parking lot in the Mojave Desert city, about halfway between Los Angeles and Las Vegas.
Cell phone video captured the moment officers opened fire on a car in the parking lot. "You can hear approximately 30 shots, we know at least 10 struck the driver," CBS Los Angeles quotes attorney Dale Galipo as saying.

Police Chief Albert Ramirez Jr. released a statement Monday night that said Yarber was wanted for car theft after he jumped out of a stolen car last month and ran away.

On April 5, officers answering a report of a suspicious vehicle in the Walmart parking lot learned that the car was registered to Yarber, Ramirez said.

After an officer stopped the Mustang, the driver opened the door and the officer recognized Yarber, who then backed up the Mustang, hitting a patrol car, moved forward and backed again, almost hitting an officer and then striking an occupied police cruiser, Ramirez said.

Four officers then opened fire because they "feared for their safety and the safety of others," the chief's statement said.

Merritt disputes the account of the shooting by police, saying Yarber's car was barely moving.

The wounded passenger, a 23-year-old woman, was airlifted to a trauma center with multiple gunshot wounds, reports the Los Angeles Times.

The two male passengers exited the vehicle and one suffered minor injuries getting out of the car, police say. The other was uninjured.

"They don't have a justification for stopping this car. They saw a car full of black people in front of a Walmart and that was suspicious," Merritt told the paper. "I don't believe I have seen a more brutal shooting. They just began pouring bullets into the car in broad daylight. The car was barely rolling backward. You can walk faster than that."

From the video, the mustang was not moving back that fast like the attorney said, but standing next to it could be different. I counted about 19 shots fired. What do you think? It's amazing these things keep happening.

The video seems to show the vehicle backing up at a rapid pace in a clear attempt to ram the police. He'd already rammed into their cruisers twice (or this was the second incident cited). He's literally in the process of assaulting officers with a deadly weapon, and I'm supposed to be outraged they unloaded on him.

Well the moment he attempted to reverse the car with the door open and police next to it he made his choice. Had the police just walked up to the car and started shooting at him it would have been wrong. They reacted to his actions, disobey and try to harm the police and things like this will happen.

From the description of events it sounds like a good shoot. Trying to kill officers is a no no

Whatever you think about the justification in this particular case to use deadly force, the incompetence in both administrating that deadly force and often in deciding on its use by the US cops is just staggering. The US police force's competence is nowhere near any civilized nation's and in fact most Third World countries seem to fare better. And the fact that there doesn't appear to be any serious political movement to revamp the recruitment and training of the police gives a pretty dysfunctional picture of the country's system at large.

Yea, it's weird. It's like unarmed black guys are dropping left and right. But oddly, there've been no threads(that I've noticed) about cops being killed by black guys, which statistically happens 19 times more often.

It's almost like the squeaky wheels on this issue are trying to justify a political agenda.
