They held the fight in Alabama in 2007. MMA was obviously unregulated there. I believe they had a gentleman's agreement that he would not throw kicks. I don't know why anyone would take a fight with him to begin with. Bryan Fry might have "won" the fight but he's still a loser for even accepting it.
