Sister being sued by insurance agency

My sister is a heroin addict and is now in rehab getting her life back together. She's doing well. Last summer she was in a car accident where she was side swiped-not her fault and it was very obvious. She was not high when driving as I saw her right after is happened and she is pretty honest about shit like that. Dude's car litterally only had a few scratches on it, but I guess could have had some damage underneath the fender. She had a suspended license and did not have insurance at the time.

So I guess the dude's insurance company is suing her for around 6K. I"m guessing even though it wasn't really her fault, they are going after her for the money they had to fork out to their client. They offered her to settle for half, but she doesn't have that money and will be in treatment for several more months and likely be employed at low wage jobs for now.

Anything she can do to maybe negotiate a better deal or does she just have to add it to the lump of other debts (fines)?
 
Even if it wasn't her fault, my non-lawyer-ass would guess she's fucked because of the suspended license/no insurance thing. I wish her luck though.
 
she has no leverage that i can see, so 3k does not sound that bad tbh. best of luck to her.

The suspended license and no insurance really doesn't giver her many options.

If she is thinking of fighting it, check with a local law school and see if they have a free legal assistance program; program will probably be for low income individuals. Here, University of San Diego does and one of the categories is
Civil—Includes consumer issues, breach of contract, uninsured motorist defense, landlord tenant, fraud and consumer debt collection disputes.


Or contact an attorney for a consultation, should be able to find one that will give her a free half or whole hour to discuss the issue. Although, giving the small amount it probably wouldn't be worth it to actually hire a lawyer. Which is probably what the insurance company is counting on - they know $3000 doesn't cover much when it comes to attorney fees.
 
An ambulance chaser will want a $2500 retainer just to talk to you.
 
If you dont have a licence and get in an accident aren't you automatically at fault

I would just tell her to tell them the truth.

Tell the insurance company she is a recovering heroin addict in treatment without a penny to her name. She is in recovery now and when she gets out she will basically be homeless. She does not have any money to give them now or any time soon.

I doubt an insurance company would litigate to collect $3000 from an essentially destitute person. Even if they won the litigation, your sister would still be broke.

The performance of subrogation claims handlers is based largely on how much and what percentage of their total debt outstanding they collect. They are basically debt collectors. As soon as they realize she can't pay, they will likely move on.
 
That sounds ridiculous enough to be true.

The root cause of the accident is driving around without being licensed to do so; i.e., being deemed unfit to drive. She shouldn't have been out driving in the first place.
 
Bad luck just seems to hover someone when dealing with the problems she is dealing with, even the bad luck that absolutely wasn't brought on by anything she did. Insurance companies can be brutal. But if she comes out and stays clean this will seem like small potatoes to her. Just hope she gets her life back. The rest is all manageable after that.
