Mouthguard dental warranty

I noticed back of a shock doctor product, it shows This dental warranty crap $10000 something, i was wondering if i broke my teeth somehow using the mouthguard, would i $$$ out of the company? Sounds too good to be true...
 
I heard of people getting broken teeth while wearing one but have no idea whether or not they were paid per the warranty for damages.

I'm a lawyer.

This is a very thin warranty --- all it says is that they will pay a certain amount if DEFECTS in the product caused the injury.

"to be free from defects in material and workmanship which could cause damage or injury to the sound, natural teeth of the purchaser herein when properly used in a supervised athletic contest or coach-supervised training session."

That's worse than nothing. Under ordinary product liability law, they are already liable for the damages from a defective product with NO LIMIT on the amount, regardless of whether it was supervised training or not, and without any restrictions on notice of claim or authentication from dentists.

The warranty means NOTHING; if anything, it's worse than no warranty.
 
Thank you. I didn't want to say that but you can read in between the lines. Your teeth have to be perfect. You have to mold the guard correctly. A supervising coach is pretty vague. They warrant there are no defects yet disclaim all liability if there are any. Double talk???

I wanted to say " SALES GIMMICK " but you nailed it right on the head.
 
From memory, I hear that it is too good to be true. There's apparently a TON of conditions taht have to be met before they pay out
 
In some defense of them. A boil and bite is better than nothing. Better that then chippin your teeth Unless you want to grab a tree branchand use that.

What is it with you and Fozzy saying the tree branch is the way to go.

In NZ, the way we do it is a orange peel. I mean esp in the 80s and 90s I hear that's what a ton of kids (like 5-10 yr olds) that play rugby use. It puts a meaning to the term "That parent's in charge of the halftime oranges this week"
