I have a legal question regarding fighters getting TUE's for TRT from the Athletic commissions.

Just because an AC decides to give a fighter a TUE for TRT or some other performance enhancer, does it then follow that the UFC is legally bound to have fighters taking TRT on it's roster.

Couldn't the UFC just take the position that they will not allow any fighters taking TRT for any reason to fight in the UFC?

I under$tnad there are Rea$on$ they might not choo$e to do that. My question is could they if they wanted to?

Maybe I do not have a good legal understanding of this, but I don't think there is any legal impediment to the UFC having stricter requirements than the Athletic commissions.

Does anyone with legal expertise have an opinion on this.
 
You are right in assuming that. What the ACs require are the threshhold to competing in that state. The UFC could both institute their own testing and not allow fighters with TRT exemptions if they wanted. There might be some litigation from a fighter that has previously been allowed to use TRT, but the UFC would win that battle by proving TRT exemptions are unfair or could potentially make them liable in the future.

THE UFC has a history of condoning illegal drug use. It's an undeniable part of their culture.

The owner, Lorenzo. Do you believe he got that size by lifting naturally?

The President. Same. Also, haven't we seen him coked up before.

The announcer, Rogan. Admitted to trying multiple illegal drugs in addition to multiple PEDs.

UFC Hall of famers busted for PEDs (and these are only those that got caught): Randy Couture (TRT), Royce Gracie, Ken Shamrock, Stephan Bonnar. Anybody that believes Matt Hughes and Mark Coleman were all natural are living in denial.

UFC Hall of famers known for taking illegal drugs: Chuck (cocaine, etc), Tito Ortiz (took just about every drug known to mankind)

The list of examples of UFC employees that have been known to take illegal substances is long.

I'm not holding my breath. I am just trying to assess a BS factor when Dana yammers on about wanting AC's to stop giving TUE's.
 
I'm not sure the UFC can stop a fighter who is currently under contract from fighting in the UFC just because he is on TRT. But what they can do is to refuse to sign or renew a contract with a fighter who is using TRT.

Why is that?

Unless there is specific contract language stipulating that, or perhaps if the fighter was taking TRT at the time they signed their contract with the UFC, but otherwise they should be legally OK, no?

Pretty much everyone that has ever taken TRT within the UFC started taking it AFTER they signed, not before.

I'm pretty sure the UFC have the ability to cut a fighter if he gets caught using PEDs, but I don't know what the UFC would be able to do with someone who uses TRT since TRT is not against the rules if you have a TUE. I guess the only way for the UFC to stop fighters from getting a TUE after they are signed would be to add a clause in their contracts which specifically states that a fighter can not use TRT while under contract. Kinda like the morals clause some athletes have in their contracts which prohibits them from getting intoxicated etc.
