In May 2021, the arbitrator found that the man and woman had sex inside his vehicle that 'directly caused, or directly contributed to cause' the HPV infection.

The ex-boyfriend was found liable for not disclosing his infection status and the woman was awarded $5.2 million for damages and injuries to be paid by GEICO.

Los Angeles personal injury attorney Miguel Custodio, co-founder of Custodio and Dubey LLP, told DailyMail.com that the settlement was reasonable.

'If you think about it as an injury sustained while in that person's vehicle, then it totally falls within what an insurance company would be required to pay,' he said.

'Usually, injuries to passengers are the result of a collision, or slamming the door on one's fingers, that sort of thing. But while a lawsuit over contracting an STD from the insured driver may be the first of its kind, this award shows that it's not a stretch for someone to file against an insurance company for any actions occurring in a motor vehicle.'

'The lesson to be learned here is that people need to broaden the scope of what an injury is,' Custodio continued. 'Most people would not think that contracting this disease is an injury suffered in a vehicle — though it definitely is.'

Doesn't this also open the door for people with home insurance to have their coverage include stupidity like STDs?
Yeah this is ridiculous. It’s not like the car have the STD to anyone. It was the action of the owner. This really should be over turned
 
Sounds like Geico fucked up.

Apparently, they have 30 days to automatically intervene in any pending lawsuits once they get notice. They were given notice and didn't intervene. Then after the case went to arbitration and the insured lost, they tried to get the arbitration award tossed out claiming they didn't get a chance to defend themselves.

That's on them. They should have read the woman's complaint, double checked their policy exposure and intervened as a matter of course. They won't make that mistake again. Also, expect all future policies for all of us to have an exception for STDs.

Also, they have other opportunities to challenge coverage but they can't challenge the underlying issue.

Auto insurance (Geico in this case) is always for owner’s actions.

Next thing you know home insurance companies are paying for child support when people get knocked up in their homes
 
Polices are being rewritten as we speak. This will be a random one off because someone took it there when most people thought they wouldnt.
 
Legal system is a joke in the US....especially civil law. Written by lawyers to benefit lawyers at the expense of average citizens. Its basically corporate welfare. Yeh...some dipshit whore got rich too but that's just a side effect.
