They're not a third category. They're part of the male female binary, just a component that is developmentally anomalous. In the same way we don't adjust everything in society because there are people born with three legs there is no reason to ultra legislate in this case. Quite simple.

You’re telling me “just call them anomolies and move on” which is not addressing the question of which category a specific one falls into.

And it’s clearly not simple because everyone I ask has a different answer. Some argue going by chromes, others by sex assigned at birth and others have suggested intersex people can simply decide for themselves (still NOT trans).

That's part of the rules application at the level of the sports authorities. They decide permitted hormonal levels upon consultation with the specialized bodies that put forward the limits.
