His argument is based on the fact that the President has to be impeached by Congress and removed from office first. Obama is no longer President. And none of his staff members were ever President...This is all amusing considering trump and his own lawyers this week have argued the president can do what he wants and is above the law.

For some context, it was a significant controversy in 2004 that John Bolton made 10 unmasking requests over a period of years when he was being confirmed for a new appointment in the Bush administration. By contrast, Obama administration Ambassador to the UN, Samantha Power, made hundreds of unmasking requests in a single year and she's just one member of his admin who did so. This is what happens when the wolves are put in charge of the hen house.
As the saying goes, if a power can be abused it will be abused which the Obama administration confirmed in spades.

The difference being that the Fugitive Slave Law once did matter. The Logan Act is not only antiquated, it was never used even in its own day, because it is a silly and unconstitutional law.
When someone suggests a crime has been committed related to the Logan Act, they are signalling that their opinion is unearned and unserious. Yates made it clear to the FBI when they brought up that a Logan Act violation may have taken place that the DoJ had no interest in pursuing any such case. It makes the FBI look very bad that they were reaching to find any crime at all to charge Flynn with.
