Has anyone went through this? I got into a mutual fight a couple of years ago and after I was pulled over for talking on a cell phone the cop arrested me since I had an warrant for assault.
 
Give any decent lawyer a few grand,it will go away...so long as the other party isn't connected at least
 
I went through it about a month after I turned 18. I got charged for assault with a weapon. I didn't have money for a lawyer so I got appointed a student lawyer, I should of got a conditional discharge and I was told to plead guilty. I didn't get the conditional discharge but I didn't do anytime as it was my first offense. I got a year and a half probation. The whole process took about a year and a bit.
 
Are we talking Doubled level assault here with correctly thrown over hand rights and forward back flips or are we talking regular shit?

I don't understand. what is the question you are asking. If you are pulled over for a motor vehicle offense it is routine that police run your license to see if s suspended/ warrants etc. if you do have a warrant then yes you will be arrested for said warrant.

He's just wanting to know what to expect as far as the assault charges go.

Me personally, I don't have any information since I'm a law abiding citizen but I'm sure some of the sewer dwelling mongloids here will let him know what's in store for him.
 
Go to court with an attorney and get a trial date for the assault. Attorney can talk you through defenses. Your best bet is to argue mutual combat and hope the other guy can be discredited. Where there witnesses to the assault?
 
I mean it really depends where you live, your past record, the exact type / degree of assault (since there are so many types of assault). The more information you provide the better, we really have nothing to go off.

Yeah, the police report was horribly one sided. This guy and his girlfriend were talking a lot of shit. Later, I asked the guy if he wanted to do anything about it and he came after me, so I kicked his ass. Now, the police report calls him a victim about 20 times

Connecticut, no record, 3rd degree assault. It seems that Connecticut is less tolerant of mutual combat also

You're probably gonna be screwed. It'll be fairly easy for a prosecution to show you instigated it, asking if he wanted to do anything about his shit talking. Also if you left prior to police arrival it looks to a jury like you fled the scene.

If he didn't have any significant injury you will likely only get Probation and a misdemeanor charge though.

On a side note, I hate assault and battery reports as a cop. It's a ton of paperwork for what usually amounts to mutual combat between two Yahoo's, then one gets his ass kicked, feels embarrassed in front of his girl or friends and then demands a police report. Huge waste of my time.

Assault in the 3rd degree is defined as:

  • intentionally causing physical injury
  • recklessly causing serious physical injury
  • with criminal negligence, causing physical serious injury with a deadly weapon

Assault in the Third Degree
  • Up to 1 year in prison
  • Up to a $2000 fine
Class A Misdemeanor

If you don't have a record I can't see you doing any prison time, unless the guy was serious hurt of something, but then it would probably be 2nd or 1st degree. But I'm Canadian so what do I know.

How much time before your first court appearance? I'd at least talk to a few lawyers that deal with criminal offenses and offer a free consultation.

There's a lot of missing info here. Do you have a witness that says he threw the first punch? How bad did you "kick his ass"?

my advice to you as a retired police officer would be to get a lawyer and have your day in court. right now it is a one sided story and you will get to tell yours. if it was just a bullshit fight and you haven't been in other trouble nothing really should happen to you. your lawyer will tell your side if they attacked you and its up to the judge/jury who is more believable. if you do nothing about it every time you are stopped by the police you will be arrested for that warrant. go to court and get it taken care of or you will be looking over your shoulder the rest of your life.
 
also if its been awhile and no real damage was done other then an ass kicking maybe the other party will choose to drop the charges. going to court might be to much of a hassle for them. good luck
 
I am trying to get my medical records. The guy's girlfriend hit me over the head with a beer bottle and cut me with it. The police report does not say anything about that. I did not hurt this guy badly. The police report said he had a bloody face.

I didn't think that they wanted to press charges because of the beer bottle thing.

That's why it's only 3rd degree (intentionally causing physical injury).

If the police thought you seriously hurt him they would have charged you with 2nd degree (right from the website I linked earlier - http://www.ctdefenselawyer.com/assault-laws/)

Assault in the 2nd degree is defined as:

  • causing serious injury
Like Chazz said, right now they only have his side of the story to go off of, which is everything in the police report. If the girl did hit you with the bottle I doubt they told police that, so that's why it's not in the report. It will be up to you to prove in court that she did.
 
I had an assault charge and they took my trusty status and moved me to the mail jail which was great they had cable tv there and our cell was right next to the felony trustees that worked in the kitchen. 1 dollar slices of them frozen school pizzas mmmm.
If you got a decent record you may be able to plea it down to a lesser charge and got off easier.
