The American Gun Rights Thread Vol. 4

Good response to the retarded 4th Circuit ruling upholding the Maryland semi-auto black rifle ban. Activist judges indeed.

http://www.newsmax.com/MichaelShannon/amendment-constitution-scotus-militia/2017/02/24/id/775439/

The role of civilian militia volunteers was codified in the Bill of Rights by the 2nd Amendment and the lasting rancor against a large regular army was found in the 3rd Amendment, which prohibited quartering troops in private homes.

The word "militia" in the 2nd Amendment means the "arms" citizens have a "right" to bear are by definition weapons of war. The Constitution doesn't give us the right to own a BB gun or participate in paintball conflicts.

The Constitution gives us the right to own and bear light infantry weapons.

That fact escapes all leftist judges. They think government grants the right, when the Constitution obviously holds the right exists independently of government, which shall not infringe upon it.

The case that cannot be made by anyone reading the plain language of the amendment and knowing anything of history is that the 2nd Amendment does not cover weapons that are either military in nature or resemble military weapons.

Yet that is exactly what the U.S. 4th Circuit Court of Appeals did when it voted 10-to-4 to uphold an unconstitutional Maryland law that bans ownership of "assault weapons and large-capacity magazines."

Ignoring "militia," "arms" and "shall not infringe" the court sounded more like Chief Justice Oprah Winfrey when it concluded, "Put simply, we have no power to extend Second Amendment protection to the weapons of war."

Only the justices don't have to extend anything, the 2nd Amendment already protects "weapons of war." Their job was to stop an obvious infringement upon that right.

Rant
That decision was just absolutely ridiculous, beyond full retard.

If I was in court hearing that...

giphy.gif

The part were they said "That ruling(Heller) limited the right to ownership of handguns for self-defense within the home."

<{hmmm}>

No... that was an example of lawful use. The ruling said that handguns fit the definition of an "arm" protected by 2nd AND "The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, SUCH AS self-defense within the home." Not limited to...

Hell part of the Heller ruling included striking down regulations that required long guns to be unloaded and disassembled or bound by a trigger lock while stored or not in lawful use.

Extending protections for weapons of war?

{<huh}

They acted like long guns were never protected by the 2nd amendment, like the "weapons of war" used in the revolutionary war. Nope those were never protected. Exactly what you quote hear says... they didn't need to extend anything. They are already protected. Wtf do they think the 2nd amendment is for.

That ruling just...

Nice!

An anonymous blogger who uses the pseudonym “Doe Publius” knew he would stir controversy when, in July 2016, he published a “tyrant registry” listing the addresses and home phone numbers of 40 California lawmakers who supported a new gun control law in the state.

“Isn’t that dangerous?” Publius asked rhetorically in a post on his blog, The Real Write Winger. “What if something bad happens to them by making that information public?”

In California, courts have ruled that similar dossiers targeting abortion providers are tantamount to death threats. Publius published his list anyway. “These tyrants are no longer going to be insulated from us,” he wrote.

The post was quickly picked up on another gun rights blog, and within days, several of the named lawmakers reported receiving threatening phone calls and social media messages. California’s legislative counsel responded by ordering that WordPress, the blogging platform Publius used, remove the post, citing a state law, based on safety concerns, that restricts publication of government officials’ personal information.

WordPress obliged.

But on Monday, a federal court ruled that the “tyrant registry” was protected speech. In a lawsuit brought by Publius, Judge Lawrence J. O’Neill of the U.S. District Court for the Eastern District of California said the post and its republishing by another blogger were “a form of political protest.”

“There is no dispute that Plaintiffs lawfully obtained and truthfully published information that was readily available online,” O’Neill continued. “When lawfully obtained, the truthful publication of that information falls within the First Amendment’s ambit.”

At least they can carry. Hawaii has no open carry and the counties refuse to issue concealed permits.

ejecting arguments by Second Amendment supporters, the Florida Supreme Court on Thursday upheld a longstanding state ban on people openly carrying firearms in public.

Justices, in a 4-2 ruling, said the state law “regulates only one manner of bearing arms and does not impair the exercise of the fundamental right to bear arms.” In doing so, the Supreme Court sided with the 4th District Court of Appeal, which ruled in 2015 against a man arrested in St. Lucie County for openly carrying a gun in a holster.

“[We] agree with the 4th District and are satisfied that the state’s prohibition on openly carrying firearms in public with specified exceptions — such as authorizing the open carrying of guns to and from and during lawful recreational activities — while still permitting those guns to be carried, albeit in a concealed manner, reasonably fits the state’s important government interests of public safety and reducing gun-related violence,” said the 47-page majority opinion, written by Justice Barbara Pariente and joined fully by Chief Justice Jorge Labarga and Justice Peggy Quince. Justice R. Fred Lewis agreed with the result but did not sign on to the opinion.

One less annoying rule.

Interior Secretary Ryan Zinke signed a Secretarial Order on Thursday repealing the lead ammunition ban issued the day before Barack Obama left office.

Many saw the regulations as a last-minute assault on gun rights by the Obama administration:

On January 19, the National Shooting Sports Foundation’s Lawrence Keane described the lead ammunition ban as the Obama administration’s “parting shot” against the hunting community. The ban was contained in Director’s Order 219–from National Fish and Wildlife Service Director Dan Ashe–and it required regional directors to work with state-level agencies to begin phasing out the use of lead ammunition on Federal land.

But effective immediately, Order 219 will be relegated to history:

Is it child endangerment for everybody or just when black people do it?

https://www.yahoo.com/news/chicago-police-hunt-man-took-160215418.html

Now investigators are trying to find the man who could face child endangerment charges.

It's unclear whether the gun in the photo is real, but the child's finger is close to the trigger. Holmes said that part of the picture is incredibly disturbing.

"Whether it's an air gun or a real gun in her hand, she's taking a selfie with a man and she's got her trigger finger on the trigger," Holmes said. "If she goes to a relative's house and there's an unsecured gun, she's going to put her hand on it because, guess what, you taught her to put her hand on it."

Police have not determined where the photo was taken. The investigation is ongoing.

Let's press charges against everyone taking toddlers to the swimming pool too. After all, if they stumble upon one they'll surely jump in and drown.

I don't know what kind of crime it is to take a pic like that, but it sure as hell is stupid.

Are you parroting the FBI's most recent ballistic tests as most departments have to do a complete dick tuck and contradict themselves after 20 years of .40cal elitism? Because I know you aren't refuting what I wrote.

RIFLE FIRST. LAST. ALWAYS.

Penis enlargement isn't really a goal.

But I guess for some, perhaps yourself considering the fixation, that is the purpose for doing things? Especially if you feel under-equipped. Good luck finding things in life that can motivate and grow your dick. I guess.
