I was 100% supportive of the Hale decision. And it was later validated when he tried to fucking murder a judge. Shit-tier law schools like Michael Cohen's are feeding far right loons into the legal system and it's quite concerning. But, regardless, his rejection was based on his doctrinal white supremacy (far beyond that which is adjacent to Trumpism) and his extensive criminal history that showed a pattern of being unable to control himself and a pattern of really suspect judgment in being able to take such patently unreasonable stances.

He did everyone a favor and will likely lose business (if he had any) and be shunned by anyone who isn't as crazy as he is.

I never heard of Hale until this thread. I have never have been sanctioned or had any ethics issues. That said my first years was spent at the Hawaii Office of Disciplinary Counsel. I did not have anything to do with discipline. I technically represented the ODC over trusteeships. If a lawyer dies or is disbarred without making arrangements his client funds are sent to the ODC and in theory the ODC disburses it back to the clients. I dealt with a rather large backlog. That said I did get to know what the ODC deals with and there are a lot of lawyers stealing from their clients and otherwise doing bad stuff in direct relationship to their work as lawyers. That should be the focus of the bar. I dealt with many trusts that were the direct result of elder abuse on the part of the lawyer where the lawyer had kept funds etc.

The standard is and should be for discipline is whether a lawyer is a risk to the public in his capcity as a lawyer. That can be presumptively proven by showing that the lawyer has committed a felony or a crime of moral turpitude. Or it can be shown through his conduct as a lawyer i.e. mismanaging client funds or incompetently handling legal maters. Now things may be different in NY. That said, I have a problem disciplining a person over
something where he was not charged with a crime or deemed by a court or mental health specialist to be unable to stand trial and where the incident does not stem from his legal practice. That is just a stretch to far.

Actually disregard my comment about Hale. I remember his case now. That is a much different situation.
Once you have received your law license you have a constitutionally protected property interest in that license. Hale had not received his license yet so there was no property interest at stake. Here, the safety of the public has to be weighed with the right of the individual in his license. With no dispositive evidence as to his fitness negatively impacting the public as applied to his performance as a lawyer, there is a presumption that he should retain his license.

The second issue at stake is the integrity of the bar. The State Bars of the various states need to show impartiality or else the public will lose confidence in them. This is not true as to the ABA because it does not have any regulatory authority. An attack on this lawyer for morally questionable behavior that in other context would not be prosecuted would make the Bar appear political. That would make the huge swaths of Northern State New York residents lose confidence in the Bar. It would appear that this fellow had been attacked for his "Trumpsim" rather than for legitimate reasons. I am litigating a case in federal court in Utica/Alabny (Northern District moves between the two and I've gotten a pretty good read of the people up there.

That said I think the Bar would be doing this guy a favor if they required he take some classes or seek some counseling. I certainly would not do business with someone like that. Not because of his world views but because he thinks its okay to start yelling at people in a public area for no reason. Even in the South where I have met many attorneys that are less than enlightened on racial issues he would not get business because acting like that is extremely shameful. That is someone that needs to take a hard look at how he is living his life.

There are multiple recorded instances of the guy acting like a clown in public and harassing, insulting and threatening people. Bar associations and law societies have rules of civility that their members have to abide by both in court and outside of it.

I'm shocked at the level of scumbaggery shown. How can you be so unhinged and uncouth and still practice law, and in New York Cit no less, and have an office in Manhattan! You surely have to be high-achieving to get to that level.

Highly-educated, upper-class raving racists express their bigotry in other ways. They'll support certain candidates, be the mouthpiece for certain movements, maybe publish some stuff about why nonwhites are causing the downfall of society. But this guy is out on the street snarling and harassing people for speaking Spanish the way you expect an Autozone employee in rural Kentucky to do.

NYC has its share of entitled little cunts like this guy, I'm sure I take ferry in/out of work with more than a few guys who might react like him, under the right circumstances, or say some nasty shit in private company. Money makes them feel separated from the rest of the population, and whenever that separation is perceived as threatened, they pop a little aneurism and go off like this cocksucker. To avoid raising a future cocksucker like this, every parent should make sure their kid has seen shit and had to work their way up without a thoroughly privileged springboard.
