Veterans Affairs Dept. tells Capitol Hill it won't repay underpaid GI Bill benefits recipients

The news conflicts with a promise VA officials made to a House committee earlier this month that it would reimburse those veterans who received less than the full amount they were due.

For weeks, student veterans across the country have raised an alarm about delayed or incorrect GI Bill benefit payments, which the Department of Veterans Affairs has blamed on computer issues.

But on Wednesday, the department told congressional staffers that it would not reimburse those veterans who were paid less than they were owed, two committee aides told NBC News.



The news conflicts with a promise VA officials made to a House committee earlier this month that it would reimburse those veterans who received less than the full amount they were due.
According to the aides, however, the VA said it could not make retroactive payments without auditing its previous education claims, which it said would delay future claims. The aides asked not to be identified because they were not authorized to speak publicly.

NBC News previously reported that some veterans were forced into desperate financial straits stemming from a change in calculating housing allowances under the Forever GI Bill, which President Donald Trump signed into law in July 2017. When its computers were unable to process that change, the VA quickly faced a backlog of veterans’ claims three times higher than normal.

Because of those issues, the VA had announced earlier on Wednesday that it would delay the Forever GI Bill housing allowance changes until Dec. 2019 — and again promised that retroactive payments would be made to those who did not receive a correct amount.


But VA officials told congressional staffers in a telephone call on Wednesday morning that once the system is made right next year, they will not make retroactive payments to those who were underpaid because of the housing miscalculations.

"They are essentially going to ignore the law and say that that change only goes forward from Dec. 2019," one aide told NBC News.

The reason the VA decided that it would not make the retroactive payments is because it would have to audit all its previous education claims prior to Dec. 2019, meaning the VA would potentially have to inspect 2 million claims, the aide said.

VA officials said this could cause further delays in processing future claims, according to the aides, an issue that caused some veterans to suffer earlier this year.


While this decision could mean the agency is flouting the law because it would not provide the correct amount of money to student veterans as required by two sections of the Forever GI Bill, the VA told the congressional staffers that they have a legal justification that would allow them to move forward with this decision.

They did not share that justification, however.

When asked for comment, a VA spokesman did not address the issue directly. Instead it reiterated that the agency would delay paying housing allowances in accordance with the new Forever GI Bill until the spring term of 2020 and instead pay housing allowances based on Department of Defense's older Basic Housing Allowance rates.

Attempting to implement the law would put “an enormous administrative burden for schools in which some 35,000 certifying officials would have to track retroactively and re-certify hundreds of thousands of enrollment documents,” Curtis Cashour, the VA spokesman, said over email.


Cashour also said that students who were overpaid because of the law’s changes or because of issues in implementing the law “will not be held liable for the debt.”

But he did not comment on those who were underpaid and rampant confusion continues to surround the issue, as it is unknown how many students have been underpaid thus far, how many more could be underpaid because of the changes to the law and how much money these veterans are owed.

Congressional aides described the situation as “frustrating.” One, who commented on the shifting answers and constant confusion stemming from VA, asked, “I mean, am I taking crazy pills?”

Under Secretary for Benefits Paul Lawrence is scheduled to testify Thursday morning before the House Committee on Veterans’ Affairs.


One of the committee aide said that members of Congress will attempt to clear this issue up before they move forward with the hearing.

“They need to figure it out,” the aide said.
 
The new generation is a challenge. It really is. Kids are different and I believe the army is struggling to find an answer. Between you I and everyone else..SFAS just had it's first female pass..

I don't know about the generation thing. Maybe high-tech has soften people in a certain way. Computers, smartphones, Facebook, Twitter, etc. People don't relate to one another face-to-face anymore, it all seems to be done through some sort of electronic device. Virtual friends. Like on Sherdog.

I don't carry a phone anymore. Not since coming off active duty. My life is very stress free these days. People want to contact me they can call my land line and leave a message on the answering machine. Too much stress during my last year on duty - a lot of it due to that stupid smartphone.

I think a lot of it has to do with some things in our culture (American). PC (political correctness), Me Too movement, gay rights, etc. Kind of shit that wasn't around 20 years ago. So, the Army is a reflection of society and has to adjust to it. Everything gets watered down these days.

A good number of soldiers of the WWII generation could not read and write. The Army had to change the qualification standards. Those boys could sure shoot, had courage, and patriotism. Soviet WWII female soldiers seem to have done ok. Not sure about females in the IDF.

I would still like to know what is going through a girls mind to want to be an Infantry soldier, Ranger, or Special Forces. I think 99% of female soldiers want nothing to do with it. The others must be on a 'pioneering' quest. Weird.

I’m kinda confused. Is the VA not gonna pay these people who haven’t been payed at all? Or is it that the people who haven’t gotten paid the past few months won’t get the updated BAH rates when they do get paid. They will get the rate that was in play while they were in school.

If they were shorted they will not get their back pay because fuck them. The VA heads need to eat a few IEDs

Yeah something has changed with new recruits, of course I'm talking generally, they're still young people that bring the right ingredients to make great soldiers. These things we're actually briefed to us from higher..

I thought SFAS was tough but Ranger school was harder. I frankly can't see how a female did what I did. I just think the standard has changed.. I'm not sure about SFAS standard wiser. During the Q I definitely carried over 110 ruck multiple times for distance. Then did Astan in mountains with around 100lbs of shit. I was dying... Getting to the ORP and doing the raid was easy compared to those humps.. I don't see a female being able to do it but I've heard staff officers and above claim females are just as capable as men physically.

Anyways, retirement dude no cell phone, I concur.

None of it makes sense to me, they implemented a 5% housing penalty to 'match how Active Duty troops receive BAH' (whatever that means), but that apparently killed their antiquated system, they then announced they'd backpay people screwed by the new system, but then walked that back......wtf

“By the end of 2018, VA will install the current year uncapped DoD BAH rates, and subsequent MHA payments will follow this rate. For many students, this rate will be equal to or higher than their current payment. Shortly after this update, VA will issue an additional payment to students who were underpaid for applicable terms. Any future terms will be processed under the existing rule set with the current academic year rates.”

...well, those staff officers are idiots. They are just falling in line with the PC stuff. No, women are not built like men. Never have been and never will be. When was the last time you saw a female fight a man in the UFC or the boxing ring? Put them in the same weight class and age and the man will always beat the woman, period. The idea that women can somehow be like men physically is ludicrous.

SFAS is only 2 or 3 weeks though, right? Maybe the Q will get her sometime over the next year or so.

Ya they send this out to us Advisors today too, looks like they're fixing it and postponing the changes (satellite campus rates, capped housing rates) until Dec 2019

I am so glad I no longer have to deal the education department of the VA. Those cunts fucked me twice before and I don't think I could deal with their shit at the moment.

a lot of people might actually be better off utilizing Vocational Rehabilitation over the GI Bill, that is if they have 20% VA Disability.

Most people don't even know about that tho

if I had time to go to a physical school again, I would get another Masters. I love love school. I just don’t wanna put up with online classes.
