When federal investigators interview witnesses, they summarize information from the witnesses on Form FD-302, a "Form for Reporting Information That May Become Testimony." These forms are referred to informally as "302's." Here is an example of a 302:
Even though the DOJ issued a 2014 "guidance" memo which presumes that the FBI will record audio of interviews of people in federal custody, the fact is most interviews are not recorded (the DOJ's "guidance" only applies to in-custody interviews, and there are many other exceptions). For that reason, 302s are often the only evidence of the witness's statements to federal investigators – something which federal prosecutors have controversially exploited to their advantage.
According to recent reports by multiple outlets and independent journalists, Senate Investigators uncovered what they believe to be alarming abuses of the FBI's 302 recording procedure. For example, according to inside sources of Journalist Paul Sperry (WSJ, Fox News, New York Post):
This story actually "broke" back in February, courtesy of Mike Cernovich (the guy who broke the story about Susan Rice's "unmasking" of Trump campaign officials), but it was largely ignored because, well... it's Mike Cernovich – he's kind of a self-important douchebag (highly punchable face).
Other news outlets have now apparently confirmed the suspicions of Senate Investigators regarding the FBI / DOJ's abuse of 302s. Byron York of the Washington Examiner has now cautiously picked up this story, reporting on a recent letter in which Sen. Chuck Grassley dropped a "little bomb" on the DOJ by "rais[ing] the possibility that the facts of [Flynn's] case — the evidence in the phone conversation transcript and the FBI 302 — might somehow be at odds with the particulars of Flynn's plea."
It's worth noting that the DOJ has been withholding one particular 302, "which, due to national security interests," was only seen by Devin Nunes and his "senior investigators during the week of January 8, 2018." Many now believe that this mysterious 302 was actually the one drafted by Peter Strzock during his interview of General Flynn.
What do you think? If it turns out that McCabe (or others in the FBI / DOJ) altered Form 302s in order to get Michael Flynn prosecuted, what are the implications for Mueller's "Russia Probe?" For the FBI? DOJ? This would certainly qualify as "huge if true."
