Law California Is Now Officially A Sanctuary State For All Illegal Immigrants

SB 54 had placed restrictions onlocal law enforcement's abilityto communicate with Immigration and Customs Enforcement, but the law doesn't limit information that's available to the public, the department said in a statement.

The agency announced that the public posting was to "enhance communication between the Sheriff's Department and our law enforcement partners to remove dangerous offenders from our community."

And the state is stepping in to say that if the government wants those records it will now require a warrant. Which isn't unusual since we see that already with medical records that an employer comes to possess. The employer can't voluntarily release employee medical information even if it's in the employee file.


Employment status and tax information is certainly not on the same level as PHI. Protected health information is personal and ..... protected.

The Orange County Sheriff's Department on Monday made the release dates of jail inmates — including those in the country illegally — publicly available online, marking the latest local revolt against California's so-called sanctuary laws.

Undersheriff Don Barnes said the action is in response to the harms done to the community under Senate Bill 54, which became law on Jan 1. and restricts local law enforcement's cooperation with federal immigration authorities. Barnes and Sheriff Sandra Hutchens vocally fought against it

"We have an obligation to safeguard our community, and we will use every tool available to help hold criminals accountable," Barnes said Monday. "Our inability to relinquish these individuals to the custody of (Immigration and Customs Enforcement) causes them to be returned to the communities which they prey upon."

An ICE spokeswoman declined to comment on the change.

"SB 54 makes local law enforcement's job more difficult and requires bureaucratic processes that could allow dangerous individuals to fall through the cracks of our justice system," Hutchens said in a statement. "My department, however, remains committed to cooperating fully with federal authorities in all areas where I have discretion to remove serious criminals from our community."

From Jan. 1 to March 19, the Sheriff's Department released 172 inmates in the country illegally into the community because state law prohibited them from notifying ICE, said Carrie Braun, a department spokeswoman.

Tax information is also protected. As is specific elements of employment records.

In Orange County, the immigration debate has quickly turned into a revolt of sorts against the state, but despite that, Santa Ana has no regrets about its support for "sanctuary" policies.

Three days before President Trump took office, the city passed a resolution declaring Santa Ana a "sanctuary" city. What was initially a symbolic statement is now a blueprint for how Santa Ana officials run the predominantly Hispanic city.

California echoed Santa Ana by passing Senate Bill 54 - the California Values Act - which limits how much local police can help federal immigration authorities.

College student Kassandra Lozano is one of the Santa Ana residents who feel such sanctuary policies give people peace of mind. "I guess people feel safe here and it gives them an opportunity to live life," she said.

But other parts of the county don't see it that way. What began as a proposed resolution in Los Alamitos quickly had a domino effect.

On Monday, Los Alamitos' City Council passed an ordinance to exempt the city from SB-54. On that same day, the Orange County Sheriff's Department decided to post inmate release dates online, including those of undocumented people.

Those moves quickly rippled outward and by Tuesday, the Orange County Board of Supervisors had voted 4-0 to join the U.S. Justice Department's lawsuit against the state over its sanctuary policies.

Mission Viejo followed suit later that night, councilmembers voting unanimously to support Los Alamitos' stance. Huntington Beach is now also scheduled to discuss the issue at its council meeting next week.

It's a rebuke of state law that has drawn praise from President Donald Trump, who tweeted, "My Administration stands in solidarity with the brave citizens in Orange County defending their rights against California's illegal and unconstitutional Sanctuary policies."



But Santa Ana officials have already felt the ire of the federal government, which threatened to pull funding over the city's sanctuary policies.

Santa Ana initially lost at $300,000-a-month jail contract with Immigration and Customs Enforcement, but it made it up in reserves. Since then, it lost one police grant of $90,000 that would have been used toward law enforcement programs.

Yet the city remains undeterred.

"These other policies of working with the federal government, ICE, unfortunately it chills," said councilmember Vicente Sarmiento. "It has a chilling effect on reporting crimes, victims reporting crimes."

For now, bolstered by the conviction that its sanctuary policies make residents safer, Santa Ana remains a city committed to protecting its undocumented immigrants in a county that seems to be growing increasingly hostile.

I’m so glad shit is finally being done .. no offense to Mexicans but wayyyy too many illegal Mexicans here in Orange County. Have to at least deport 1/3 of the illegals. It’s a start. Hopefully the whole county gets involved. Santa Ana will be impossible.

Thank God there are still people of sense in this state. The battle now will be turning LA county. It will be difficult but not impossible. Things are getting bad to the point where people can no longer look the other way.

Also not shocking a La Raza Democrat supports anti-American policies. Never thought in my life I'd be rooting for Feinstein for Senate.
 
San Diego County considers suing California over 'sanctuary state' law

The pushback against California's "sanctuary state" law may soon move from Orange County to San Diego County, where the Board of Supervisors and Escondido City Council will decide soon whether to join the backlash.

Escondido Mayor Sam Abed and Councilman John Masson have put an item on the Sunday agenda that would authorize the city's filing of a legal brief in support of the federal government's lawsuit challenging three state laws enacted last year.

"I expect it to pass," Abed said Wednesday.

The San Diego County Board of Supervisors is expected to discuss the matter in closed session on April 17.

"I've always supported the great working relationship between the Sheriff's Department and federal law enforcement agencies, and it needs to continue," said Supervisor Dianne Jacob, adding that she intends to support the county joining the lawsuit.

Escondido appears to be the first city in San Diego County to tackle the issue.

The inland North County city would join the Orange County Board of Supervisors, which on Tuesday voted 4 to 0 to join the federal lawsuit as a "friend of the court." Several other cities in Orange County are also beginning to take action against the state's sanctuary laws.

Senate Bill 54, signed by Gov. Jerry Brown last year, prohibits state and local police agencies from notifying federal officials in many cases when they have immigrants in their custody who could be subject to deportation.

San Diego County supervisors will consider the Trump administration's lawsuit against the state's sanctuary policy as well as California's lawsuit against the administration's decision to ask about citizenship in the 2020 census when members convene in closed session April 17, said a spokeswoman for Supervisor Kristin Gaspar.

The board typically doesn't discuss lawsuits openly, but any decision to take a side in the cases would later become a matter of public record.

Though the city is more than 50% Latino, Escondido Councilwoman Olga Diaz, the lone Democrat and Latina on the council, often finds herself on the losing end of 4-1 votes. She said Wednesday that she has not yet seen what the council will be asked to vote on next week, but said she will "be engaged" when the vote is taken.

"Here we go again," she said.

Liberal California is a sick, sick place.

How every single citizen democrat, republican, white, black or latino does not vehemently oppose SB 54 is utterly dumbfounding to me.

This state does next to nothing to protect its citizens. They restrict firearms as much as possible, they effectively encourage illegals to vote, they protect and harbor illegals and they fleece taxpayers to provide them with preferential social services. And what the fuck is with this fake outrage about asking people during a census (a motherfucking census!!!!) if they are illegal or not?? It's a perfectly damn reasonable question.

I mean really, what the fuck, how much must you hate yourself and your country to vote for any democrat in that state...
