Last time he got an exemption so that he didn't have to take 4 months of tests before the fight. He was still tested pre-fight, that's when he failed.

Before he re-signed last time, the policy said there was a 4 month testing period that the UFC could opt out of it it were unfair to the athlete or in exceptional circumstances. It's since been rewritten, due to fuck ups with Brock (he failed) and Angela Hill (she missed a fight after being re-signed when she'd been cut). They can't opt out of Brock's testing, they can opt out of testing for someone who's been cut but never failed a drug test.
